What is Kratom?

Kratom is a tropical tree native to Southeast Asia. Consumption of its leaves produces both stimulant effects (in low doses) and sedative effects (in high doses), and can lead to psychotic symptoms, and psychological and physiological dependence. Kratom leaves contain two major psychoactive ingredients (mitragynine and 7-hydroxymytragynine). These leaves are crushed and then smoked, brewed with tea, or placed into gel capsules. Kratom has a long history of use in Southeast Asia.

Is Kratom Legal in Oregon?

Oregon kratom users are in luck, because it's legal to purchase, sell, possess, and use kratom in Oregon, all without fear of legal issues. However, there are some restrictions:

  • Age Restriction: It is illegal to sell kratom to individuals under 21 years of age.

  • Regulations for Sellers: Manufacturers and retailers selling kratom products must disclose kratom as an ingredient and must comply with regulations like third-party testing.

  • Processor Registration: Processors who sell or distribute kratom products on a wholesale basis need to register with the Oregon Department of Revenue.

Oregon has enacted the Kratom Consumer Protection Act (KCPA) to protect consumers from unsafe or adulterated products. This makes Oregon one of several states that regulate the sale and production of kratom, even though it's not federally regulated.
